FAQ (Frequently Asked Questions)

My case is worth less than £3million - will Harbour still fund it?
It is unlikely, unless the costs are very minimal (e.g. less than £150,000 for all costs) and proportionate to the claim.

How long does the application process take?
That depends on how much information is available about the case - the more information that we receive, the quicker the review process, but we will always keep you apprised of where we are in the process

Is litigation funding permitted in the UK?
Yes it is. Some lawyers still think it is not but they are wrong. As long as the funder does not control the Claimant in their conduct of the case, funding is completely lawful. See Arkin and Civil Justice Council in the glossary of terms

When are the bills paid by Harbour?
Harbour pays bills on a monthly basis. If monies are required to be paid into court, e.g. payment for security for costs or an insurance premium then Harbour will make those payments as requested.

Do I need to have my case appraised by a lawyer?
Yes you do. The case must have had at least an initial appraisal of its merits by a lawyer. Harbour is not a legal advisor and cannot provide advice on the merits of your case.

How soon before the trial of my case should I approach Harbour for funding?
Realistically the minimum period before trial should be three months as we have to complete our own due diligence and be satisfied we are happy with the claim

I don't need funding for all my costs - will Harbour pay part of my costs?
Absolutely. Harbour is happy to consider funding for all or part of the costs of an action

I have a claim but no legal advisor - can Harbour help me find an advisor?
Harbour is happy to make recommendations but we are not legal advisors.

I don't know what the defendant's asset position is - how can I find out?
There are companies who can find such information, for a fee.  Harbour can make recommendations about which companies to approach.

What is the largest case Harbour would fund?
There is no upper limit on the size of cases we can fund.
